Swoop Junk

Terms of Use

Last updated: October 2026

These Terms of Use ("Terms") govern your use of swoopjunk.com (the "Site"), operated by Swoop Junk ("Swoop Junk", "we", "us"). By using the Site or submitting a request, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Site.

1. What we are (and are not)

Swoop Junk is a free referral and marketing service. When you submit a request, we pass it to independent junk removal and hauling companies ("Providers") that serve your area so they can contact you.

2. How we are paid

The Site is free for you. Providers pay us a fee for the requests we send them. This means we are compensated when your request is shared, and the Providers you are matched with are businesses that pay to receive requests, not a complete list of companies in your area.

3. Who can use the Site

You must be at least 18 years old and located in the United States to submit a request. You may only submit a request for yourself or for a property or business you are authorized to act for.

4. Your request and the information you give us

5. Calls, texts and emails

When you check the consent box and submit a request, you agree that Swoop Junk and up to three Providers may contact you about your request by phone call, text message and email at the contact details you provided, including calls and texts made using automated technology or prerecorded or artificial voice messages. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply.

You can withdraw consent at any time by any reasonable means, for example by replying STOP to a text, telling the caller you no longer want to be contacted, or emailing [email protected]. Reply HELP for help. Opting out with us stops future contact from us; Providers that already received your request will honor opt-outs you send them directly.

6. Prices and other information on the Site

Prices, timeframes and other details on the Site are general estimates based on typical jobs in the area. They are for information only and are not offers or quotes. Only the Provider can give you a price, and it may differ from what the Site shows. Confirm the price, scope and terms with the Provider before any work begins.

7. Choosing a Provider

You are responsible for deciding whether to hire a Provider. Before hiring, we recommend you confirm the Provider's business license, insurance and, where the work requires it (for example demolition or structural work), a valid California contractor license, which you can check at cslb.ca.gov. Ask for the price in writing. Providers are solely responsible for their work, their pricing, their compliance with law (including disposal and recycling rules), and any damage, loss or injury connected to their services.

8. Acceptable use

You agree not to:

9. Intellectual property

The Site and its content, design, text and graphics belong to us or our licensors. You may view the Site for your personal, non-commercial use only.

10. Third-party sites

The Site may link to sites we do not control. We are not responsible for their content, policies or practices.

11. Disclaimers

THE SITE AND OUR REFERRAL SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE MAKE NO WARRANTY ABOUT ANY PROVIDER OR ANY PROVIDER'S SERVICES, PRICES, LICENSING, INSURANCE, AVAILABILITY OR CONDUCT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY ACT, OMISSION, SERVICE, PRICE, DAMAGE, LOSS OR INJURY CAUSED BY ANY PROVIDER, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100). Some laws do not allow these limits, so they may not fully apply to you.

13. Disputes with Providers

Any dispute about a Provider's services, pricing or conduct is between you and that Provider. To the extent permitted by law, you release us from claims arising from those disputes. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

14. Indemnification

You agree to indemnify and hold us harmless from claims, losses and costs (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site, including submitting information you were not authorized to submit.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute with us will be resolved in the state or federal courts located in Orange County, California, except that either party may bring an individual claim in small claims court.

16. Changes and other terms

We may update these Terms by posting a new version on this page with a new "Last updated" date. Changes apply to use of the Site after they are posted. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us about the Site.

17. Notice to California users

Under California Civil Code Section 1789.3, California users are entitled to the following notice: the Site is free to consumers. The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs can be reached in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
